Employer Nomination Scheme Visa (Subclass 186)

The Subclass 186 Employer Nomination Scheme (ENS) visa is the primary avenue for employer-sponsored immigration, enabling foreign workers to establish permanent residence in Australia. This visa offers three distinct streams:

  1. Direct Entry Stream

  2. Labour Agreement Stream

  3. Temporary Residence Transition Stream

Subclass 186 - Employer Nomination Scheme Visa (Direct Entry Stream)

Under this visa stream, you can have the following privileges:

  • Secure permanent residency in Australia

  • Sponsor eligible family members for their visas

  • Pursue Australian citizenship, provided you fulfill additional eligibility criteria

Requirements for Subclass 186 Direct Entry Stream

To qualify for a Subclass 186 visa under the direct entry stream, you must meet the following conditions:

  • Receive a nomination from an Australian employer

  • Hold an occupation that is listed among the eligible skilled occupations for this visa

  • Possess a minimum of three years of experience in your selected occupation, unless you are exempt

  • Obtain a positive skills assessment unless you are exempt

IELTS requirements: To be eligible for a Subclass 186 visa under the direct entry stream, you are required to showcase Competent English skills. This entails achieving a minimum IELTS band score of 6.0 in each of the four components.If you decide to include family members in your visa application, and they possess less than Functional English skills, there may be an additional fee. Functional English proficiency is defined as an average band score of at least 4.5 across the four test components.

Subclass 186 - Employer Nomination Scheme (Labour Agreement Stream)

The labour agreement stream of the Subclass 186 visa closely resembles the direct entry stream, yet it has some distinct variations, which include:

  1. The sponsoring employer must hold a valid labor agreement.

  2. Applicants must be below 45 years of age at the time of visa application unless otherwise specified by the labor agreement.

  3. The requirement to provide a skills assessment may be waived (you will be informed by the Department of Home Affairs if a skills assessment is necessary).

IELTS requirements: The labour agreement stream of the Subclass 186 visa does not have a predefined IELTS requirement. Instead, your English language proficiency must align with the specific criteria stipulated in the labour agreement established with your sponsoring employer. To determine the precise level of English skills expected for this stream, refer to the terms outlined in your employer's labour agreement.

Subclass 186 Employer Nomination Scheme (Temporary Residence Transition Stream)

Under this visa stream, skilled workers who receive nominations from their employers can establish permanent residency in Australia.

Key requirements include:

  • Holding a 457, TSS, or a related bridging visa (A, B, or C).

  • Typically, having a minimum of three years of full-time employment with your employer.

  • Receiving a nomination from your employer.

IELTS requirements: To be eligible for a Subclass 186 visa under the direct entry stream, you are required to exhibit Competent English proficiency, which corresponds to achieving an IELTS band score of at least 6.0 in each of the four components.

Subclass 482 - Temporary skilled shortage (TSS) visa

This visa category provides the opportunity to reside and work in Australia on a temporary basis, with two distinct streams available:

  1. Short-Term Stream: Applicants in this stream must hold a job that is listed on the Short-Term Skilled Occupation List (STSOL). If the visa is approved, you can remain in Australia for up to two years, or up to five years if you possess a Hong Kong passport.

  2. Medium-Term Stream: Those opting for the Medium-Term Stream should hold a position included on the Medium and Long-Term Strategic Skilled List (MLTSSL). If granted, this visa allows you to stay in Australia for up to four years.

Common requirements for both Short Term and Medium-Term applicants include:

  • Obtaining a positive skills assessment

  • Accumulating at least two years of work experience in the nominated occupation

  • Restricting employment to the nominating employer while in Australia

IELTS requirements for Short-Term and Medium-Term ApplicantsFor short-term applicants, getting an IELTS overall band score of 5.0 is necessary, with a minimum score of 4.5 in each of the four test components. Medium-term applicants, on the other hand, must secure an IELTS overall score of 5.0, with at least 5.0 in each of the four test components.

Subclass 494 - Skilled Employer Sponsored Regional (Provisional) visa

The Subclass 494 visa offers the opportunity to reside, work, and pursue studies in a designated regional area of Australia for a duration of up to five years. Moreover, it opens the path to applying for permanent residency three years after visa approval.

Visa eligibility criteria to qualify for this visa, you must meet the following requirements:

  1. Receive a nomination for a position listed on the relevant skilled occupation list.

  2. Possess a minimum of three years of experience in your chosen occupation.

  3. Have a positive skills assessment.

  4. Engage in employment with your nominating employer while in Australia.

IELTS requirements: To be eligible for a Subclass 494 visa application, you are required to prove your English language proficiency, which equates to getting an IELTS band score of at least 6.0 in each of the four test components.
